Overview

ChatGPT (short for Chat Generative Pre-trained Transformer) by OpenAI is an artificial intelligence large language model which interacts with users in a conversational way to answer questions. The terms say ChatGPT may automatically collect personal information and usage information about a user's use of the services, such as the types of content that they view or engage with, the features they use and the actions they take. The terms say OpenAI may use the data users provide to improve their future models. Users can opt-out of training in ChatGPT settings (under Data Controls) to turn off training for any conversations created while training is disabled. The terms also say ChatGPT will not use data submitted by customers via ther API to train or improve their models, unless users explicitly opt-in to share their data with them for this purpose. In addition, the terms say ChatGPT does not sell users' data to third parties. However, the terms do not disclose whether ChatGPT can display targeted advertisements to users, send third-party marketing communications, or track users based on their interactions with ChatGPT on other apps or services across the internet for advertising purposes. Lastly, the terms say that if users are 13 or older, but under 18, they must have consent from their parent or guardian to use the services.

ChatGPT can be accessed through its website, and is available for download at the iOS App Store. The Privacy Policy and Terms of Use used for this evaluation can be found on ChatGPT’s website. Additionally, other policies used for this evaluation include: Service Terms, API Data Usage Policy, and Usage Policy. This evaluation only considers policies that have been made publicly available prior to an individual using the application or service.
